Marketplace Terms & Conditions
These terms define the relationship between the marketplace, buyers and independent sellers.Effective: 15 September 20261. Acceptance and eligibility
By accessing or using the marketplace you agree to these Terms, the Privacy Policy, Returns Policy and any product or seller rules shown before transaction. If you do not agree, do not use the service.
You must be legally capable of entering the relevant transaction. A person acting for a business confirms authority to bind that business.
2. Marketplace role and independent sellers
Pahad Ki Dukaan provides marketplace technology, catalogue discovery, checkout and support coordination. Unless a listing expressly states otherwise, the identified seller is the supplier and remains responsible for product legality, authenticity, quality, labels, licences, tax documents, packing and fulfilment.
Marketplace review, a verified badge or seller approval is not a guarantee of every statement, continuous availability or suitability for a particular purpose.
3. Accounts and security
Information supplied for an account must be accurate and kept current. You are responsible for activity under your credentials and must promptly report unauthorised access.
You must not share passwords or OTPs, impersonate another person, create deceptive accounts, scrape restricted data or interfere with marketplace security and availability.
4. Listings, prices and availability
Images and descriptions aim to identify the product but natural, agricultural and handmade goods can vary reasonably by batch, season, colour, finish, weight tolerance or packaging. Material specifications displayed at checkout govern the order.
Prices, discounts, tax display and stock can change before an order is accepted. Obvious pricing, catalogue or technical errors may be corrected and affected orders cancelled with an appropriate refund.
5. Orders and contract formation
Placing an order is an offer to purchase. An acknowledgement does not necessarily mean acceptance. Acceptance can depend on payment authorisation, stock, seller confirmation, serviceability and compliance checks.
Orders may be split by seller or shipment. The marketplace can impose quantity limits or cancel suspicious, prohibited, unavailable or incorrectly priced transactions.
6. Payments and fraud controls
Payments may be processed by third-party gateways under their terms. You authorise the amount shown at confirmation and must use a lawful payment method. Payment status can remain pending while provider confirmation is received.
We may delay, cancel, refund or request verification where fraud, chargeback, sanctions, identity, technical or compliance concerns reasonably arise. Never send payment outside the approved checkout at a seller request.
7. Shipping, delivery and risk
Shipping charges and available options are displayed before payment. Unless free shipping is shown, the standard rule is ₹80 for the first chargeable quantity and ₹30 for each additional chargeable quantity, subject to any clearly disclosed future revision.
Delivery estimates are not guarantees. Weather, remote terrain, carrier events, regulatory checks, festivals and force-majeure events can cause delay. Responsibility and risk are determined under applicable law and the confirmed fulfilment record.
8. Returns, refunds and cancellations
Eligibility is governed by the Returns, Refunds & Cancellations Policy and product-specific conditions. Perishable, opened, hygiene-sensitive and customised goods can be restricted, while genuine damage, wrong supply or material misdescription remains reviewable.
Refund posting time after initiation is controlled by banks and payment providers. Fraudulent returns, substituted goods or manipulated evidence are prohibited.
9. Seller obligations
Sellers must maintain accurate identity, licences, tax and payout details; lawfully source products; keep stock and prices current; use safe packaging; dispatch on time; support valid claims; and comply with food, consumer, advertising, intellectual-property and e-commerce rules.
Sellers are responsible for verifying AI-assisted copy and must not publish unsupported medical, organic, GI, certification, origin or performance claims. The marketplace may edit, suspend, reject, recall or remove listings and withhold settlement as reasonably required for claims or compliance.
10. Prohibited conduct and products
Users and sellers must not offer illegal, unsafe, counterfeit, stolen, adulterated, recalled, unlicensed regulated or rights-infringing goods; manipulate reviews; divert transactions; misuse customer data; or introduce malicious code.
Additional category standards may apply. Removal from the marketplace does not prevent lawful reporting to authorities or rights holders.
11. Content and intellectual property
Marketplace software, design and brand assets are protected. Sellers grant the marketplace a non-exclusive, worldwide, royalty-free licence to host, format, translate, promote and display listing content for operating and marketing the marketplace.
The seller confirms it owns or is authorised to use submitted images, marks and copy. Rights complaints should be raised through Support with sufficient identification and evidence.
12. Reviews and communications
Reviews and support submissions must be honest, relevant and lawful. We may moderate spam, threats, personal data, conflicts of interest and manipulated content without changing a genuine opinion merely because it is negative.
Operational notices may be sent for orders, account security, policy or support. Optional marketing can be controlled where required.
13. Disclaimers and limitation
To the extent permitted by law, the marketplace is provided on an available basis and does not warrant uninterrupted operation or independent seller performance. Nothing excludes liability that cannot legally be excluded.
Where legally permitted, Pahad Ki Dukaan is not liable for indirect, special or consequential loss, loss of profit or seller misconduct beyond the marketplace role. Any liability is limited to a reasonable amount connected with the affected transaction, subject to mandatory law.
14. Indemnity
A seller or user responsible for unlawful content, product, conduct, tax, data misuse or third-party rights violation agrees, to the extent allowed by law, to defend and indemnify the marketplace and its operators against resulting claims, penalties, costs and reasonable professional fees.
This provision is applied proportionately and does not remove non-waivable consumer protections.
15. Suspension and termination
We may restrict or terminate access for material breach, safety or fraud risk, repeated policy abuse, legal requirement or conduct harmful to users or the service. Where appropriate, notice and an opportunity to respond may be provided.
Terms that by nature survive termination—including payment, intellectual property, disputes and liability provisions—continue to apply.
16. Governing law and disputes
These Terms are governed by the laws of India. Parties should first raise a detailed support request and attempt good-faith resolution. Consumer rights and jurisdiction that cannot lawfully be restricted remain unaffected.
Subject to mandatory law, disputes are subject to the competent courts having jurisdiction over the marketplace operator. Arbitration or another dispute mechanism may be introduced only through a clear lawful update.
17. Changes and contact channel
We may update these Terms for legal, security or service changes. The effective date will be revised and material changes may be notified through the marketplace. Continued use after an applicable update constitutes acceptance where permitted by law.
